MOAB — A Grand County judge denied a motion to close the preliminary hearing of 28-year-old Rex Allen Cross, accused of killing three people while driving drunk. The Deseret Morning News, the Salt Lake Tribune and The Associated Press took the lead in opposing the motion to close the preliminary hearing, with the Moab Times Independent and the Uintah Basin Standard joining. All of the media were singled out in defense attorney Robert Archuletas motion as potentially prejudicing the jury pool and compromising Cross right to a fair trial. Cross faces three felony counts of vehicular manslaughter stemming from a head-on collision on U-128 just outside of Moab. Cross is accused of driving drunk Oct. 3 when his car collided head-on with a car driven by Kathleen Perry. Kathleen Perry, 35, and her parents, Olive Parry, 67 and James Parry, 72, were killed in the accident. Kathleen Parrys 6-year-old daughter, Emma — who was also in the car at the time of the accident — survived. Emma is now living with relatives in Roosevelt. Seventh District Judge Lyle Judge Anderson ruled against the motion for a closed preliminary hearing after Grand County Attorney Happy Morgan agreed to conduct the hearing without reference to issues Archuleta may move to suppress in trial. Those include a blood draw taken from the defendant after the accident and a discussion the defendant allegedly had with investigating deputy Curt Brewer. Salt Lake attorney Michael OBrien filed an 11-page argument with the 7th District Court last week on behalf of the media and made an appearance by phone Tuesday. In his brief, OBrien maintained that “constitutional and common-law rights of access to courts and documents related to the actions of the courts” overrides the defenses claim that an open hearing will prejudice the jury pool.

Van Hollen and The Century Council partnered today to bring a life-saving lesson about the dangers of drunk driving and underage drinking to students of Brookfield Central High School. Brandon Silveria and his father Tony spoke to students about the importance of “making the right choice” about alcohol - and if students are under the age of 21, that the only responsible decision is not to drink. Brandon was involved in an alcohol-related crash at age 17 just before his high school prom. The Century Council is a national not-for-profit organization funded by distillers dedicated to fighting drunk driving and underage drinking. “According to a 2007 report by the National Highway Traffic Safety Administration, in 2006, 2,642 youths were killed in alcohol-related traffic crashes across the country,” said Attorney General Van Hollen. “It is important that we continue in our efforts to stop drunk driving and underage drinking. Parents play the most important role in keeping teens of Wisconsin safe and alcohol-free. I am proud to have Brandon and Tony Silveria with us today to communicate their life-saving message.” “In Wisconsin in 2007, 641 youths under age 18 were arrested for driving under the influence and 10,212 youths were arrested for liquor law violations (UCR 2006),” said Shannon Adams of The Century Council. “Our goal with this presentation is to raise awareness about this serious problem and help our youth to make the right choice about alcohol. Im pleased we were invited to Brookfield Central High School today, and I am hopeful that Brandon and Tonys words will resonate with the students.” During the presentation, Brandon Silveria told students his wrenching story of how as a high school student he had everything a teenager could want–a job, a girlfriend and plans for the future–until he had a few drinks at a party and chose to drive home. After falling asleep at the wheel, crossing the centerline and crashing into a tree, he was left in a coma for three months and spent several years in rehabilitation. Brandon was so badly injured that basic motor functions such as walking, talking and swallowing had to be re-learned. He has permanent brain injury and suffers from dangerous seizures. Brandons presentations continue to receive standing ovations from students across the country. “What you become depends on the choices that you make,” said Brandon. “When I was seventeen, I had a job and a girlfriend. Because of my crash, I lost both of them. My hope is that by sharing my experiences with other young people, I can prevent others from being hurt or killed.”

SAN DIEGO — The state of Georgia recently enacted life-settlement provider licensing requirements, and Life Settlement Solutions Inc., one of the nations premier sources of life-settlement funding, was among the first life-settlement providers to receive a license under the law. Georgia issued Life Settlement Solutions viatical (life) settlement provider license Jan. 12, 2007. Life Settlement Solutions has done business in Georgia since 2003, prior to life-settlement transactions being regulated in that state. The state expanded its viatical settlement laws to include life settlements, effective Nov. 5, 2005. Prior to the enactment of the 2005 legislation, life-settlement companies were allowed to conduct business in the state without licensing requirements. The new law provided for a transitional provision that permitted life-settlement providers previously conducting life settlements in the state to continue doing so while their license applications were pending, so long as the application was filed within 30 days following the effective date of the act. Life Settlement Solutions application was filed within that 30-day period, so there has been no interruption with the firms ability to conduct business in Georgia. “In addition to application materials, biographical submissions by officers, background checks and a review of Life Settlement Solutions plan of operations, Georgia also utilized a field-examination process under which it retained an independent examination firm that conducted a field audit of Life Settlement Solutions business practices and a review of closed case files,” said Larry Simon, president and founder of Life Settlement Solutions. “Our unblemished regulatory and compliance track record speaks highly to our ability to obtain licensing in every life-settlement regulated state throughout the nation. Since the late 1980s, the increased turnover and exposure associated with payment settlements has led to a stronger focus on risk and to major changes in the organisation of payment systems, both nationally and internationally. In order to reduce settlement risk, standards were introduced for net settlements. The most important of these is the Lamfalussy standard (BIS 1990)2) . Net settlements must satisfy six recommendations concerning legal, organisational, liquidity and operational conditions in order to be regarded as protected net settlements according to this standard. In the Trundle Report (BIS 1999 and 2001) these recommendations have been made more specific and expanded to the ten BIS Core Principles for Systemically Important Payment Systems. The Trundle recommendations encompass both gross and net settlements and also contain recommendations concerning the central banks role in the payment system and responsibility for the implementation of the core principles. Central to both Lamfalussy and Trundle recommendations is the requirement that it must be possible to make a settlement even if the bank with the largest net debit position lacks cover. The principle is that settlement execution should be assured by the other participants supplying liquidity on behalf of the illiquid participant (collective guarantee). The amount of liquidity individual participants have to supply will tend to depend on the size of the bilateral credit lines they have given the bank that cannot meet its commitments. It must be assumed that in principle a bank will not provide lines of credit that cause it to have problems meeting its own commitments. However, the possibility of more than one participant failing cannot be excluded. In such cases, even protected net settlements may involve too great a risk. In consequence it is recommended that real time gross settlement (RTGS) be used for large-value payments.

The laser industry is poised for substantial growth, reports Frost Sullivan (Mountain View, CA). Global demand for industrial laser systems should grow from $1.2 billion in 1992 to more than $2 billion by the end of the decade. Major technical trends include higher power for sealed carbon dioxide (CO^sub^2) laser systems and Nd:YAG laser systems, new crystals for tunable solid-state laser systems, blue diode lasers with output near 623 nm, and 193 nm excimer lasers for industrial applications. These new laser technologies are replacing existing laser systems as well as other manufacturing techniques. Examples include using tunable solidstate lasers instead of dye lasers and diode lasers in place of helium neon (HeNe) laser systems. In related news, the US Department of Energys Argonne National Laboratory (Argonne, IL), operated by the University of Chicago, and Spawr Industries (Lake Havasu City, AZ), a specialist in high-power laser technology, are partners in a twoyear project to improve lenses and mirrors to shape laser beams for industrial use. The cooperative RD agreement also may improve laser thermal simulation in testing components found in jet engines and particle accelerators for their ability to withstand heat. The projects primary focus is improving Spawrs radiometric power meter for high-energy lasers. The conventional measurement method takes 10 sec to absorb the total laser beam; the Spawr instrument measures laser power in one second by sampling a known fraction of the laser light and has a wider application range. Additional research areas include improving coatings for Spawrs laser dump to handle high-power density laser beams. The dump absorbs laser energy while a beam is tuned for a specific application. An example of Nd:YAG lasers displacing conventional processing comes from the Raycon Laser Group (Ann Arbor, MI), developers of a flexible system for laser scribing and drilling powder-metal (PM) connecting rods. Two stress risers (the starting points for fracture splitting the lower crankshaft journal bore from the upper journal bore) are created by producing V-shaped notches 180 degreesapart in the crank bore. The rods-consisting of carbon copper, manganese, phosphorus, sulfur, silicon, chromium, nickel, oxygen, and iron-offer greater precision performance, improved weight accuracy over conventional metal rods, and reduced manufacturing costs. Prior scribing methods-broaching the Vshaped notch or producing it with a forging die-required higher forces to split the rods. The laser scribing process begins at the bottom of the journal surface and moves upward to blow slag through the kerf. The inside journal surface is mounted at 45 degreesto the beam to allow for nozzle clearance. Kerf width is between 0.008 and 0.010″ (0.20 and 0.25 mm), and depth is 0.020-0.030″ (0.51-0.76 mm). Feed rate, which affects kerf depth and the slag buildup, is 60 ipm (1524 mm/ min). To help produce a clean scribe, oxygen assistance at 70 psi (480 kPa) and a high-power YAG at 120 W also are used. According to Raycon, the force required to fracture a laser scribe stress riser is only 3000-8000 lb (13 500-35 500 N), whereas the force required for a broach scribe is 18,000 lb (80 000 N). The V-shape method is economical because it reduces the stages of manufacturing, increases the load-bearing capability of the part, and produces a perfect fit between the rod and cap.

Ever since CPSC revised its childrens clothing flammability standard, there have been outcries that children are not being protected from accidental injury caused by fire. The data showed, however, a dramatic drop in burn injuries related to childrens clothing. Now, CPSC will have an excellent data collection tool to get accurate counts on burns related to childrens clothing. The agency has a cooperative effort with the American Burn Association and Shriners Hospitals for Children, called the National Burn Center Reporting System. At the same time, CPSC is working cooperatively with the National Association of State Fire Marshals (NASFM) to attempt to retrieve and preserve the clothing involved in such burn injuries. The NASFM has recommended that a committee consisting of the National Volunteer Fire Council, the National Fire Protection Association, the International Association of Fire Chiefs, and NASFM develop a protocol for use by “first responders” across the country. Library Square will be getting a new look this spring and summer. The limestone pavers on the square surrounding the City Library, 210 E. 400 South, are weathering and cracking and will be replaced. The design and contracting team that installed the pavers will pay for replacements. The new pavers are granite and look similar to the old Jerusalem pavers but should withstand Utahs weather better.
